Terms and Conditions for the Use of the OncoExpertAi.com Platform

Please read these terms and conditions (“terms”) carefully before using the OncoexpertAI online platform (“platform” or “site”), operated by Dr. Onisim Florin – Senior Consultant in General Oncology and Chemotherapy, hereinafter referred to as “provider”, “we”, or “OncoexpertAI”.

By accessing and using this platform and the services offered, you (“user”, “patient”, or “client”) confirm that you have read, understood, and agree to fully comply with these terms, as well as the privacy policy and refund policy, which are an integral part of this agreement. If you do not agree with any of these terms, please do not use the platform.

1. Definitions

  • Platform/site: the OncoexpertAI.ro website and all associated subdomains and pages.

  • Provider: Bucharest, Sector 1, 136 Bucureștii Noi Blvd., unique registration code (CUI/CIF) 51724580, represented by Dr. Onisim Florin, Senior Consultant in General Oncology and Chemotherapy.

  • User/patient/client: any natural person who accesses the platform and/or purchases the services offered.

  • Services: oncology medical consulting services, case analysis and/or second opinion, assisted by artificial intelligence (AI), offered by the provider through the platform, according to the descriptions and pricing plans presented.

  • Artificial intelligence (AI): the software system used by the provider as a support tool for analyzing medical data and generating relevant information in an oncological context.

  • Content: all information, texts, graphics, images, logos, generated reports, and any other material present on the platform or provided as part of the services.

  • Informed consent: the explicit and informed agreement of the user for the processing of their medical data and the use of AI, according to the dedicated document.

2. Description and Nature of Services

2.1. OncoexpertAI offers specialized medical consulting services in the field of oncology, consisting of the analysis of medical documents provided by the user, with the support of an artificial intelligence system, and the preparation of a written report by Dr. Onisim Florin. Services may include case analyses, disease stage assessments, identification of possible therapeutic options according to international guidelines, answers to specific questions, and, depending on the chosen plan, telephone discussions for clarifications.

2.2. Informational and support role: the user understands and accepts that the services offered by OncoexpertAI are strictly informational, for consultation, and decision support. The reports and information provided do not constitute a definitive medical diagnosis, do not replace a direct and personalized medical consultation with the user’s attending physician, and do not represent a direct treatment recommendation that can be applied without the approval of the attending physician.

2.3. Not emergency services: OncoexpertAI services are not intended for emergency medical situations. In the event of a medical emergency, the user must immediately contact the 112 emergency service or go to the nearest emergency medical unit.

2.4. Role of artificial intelligence (AI): AI is used as an advanced analysis and support tool for Dr. Onisim Florin. It helps in rapidly processing a large volume of data, identifying patterns, correlating information with international medical databases and current guidelines. The final medical decision, interpretation of AI results, and report preparation belong exclusively to Dr. Onisim Florin. The AI system does not make autonomous medical decisions.

2.5. Inherent limitations: the user acknowledges that any medical analysis, including AI-assisted analysis, is based on the information provided and medical knowledge at the time. Medicine is a constantly evolving field, and new discoveries may emerge. Also, AI systems, although advanced, may have limitations and are not infallible. The provider makes all reasonable efforts to ensure the accuracy and relevance of the information but cannot guarantee the total absence of errors or omissions.

3. Eligibility and User Account

3.1. To use the services, the user must be at least 18 years of age and have full legal capacity or, in the case of minors or persons without legal capacity, act through their legal representative.
3.2. The user is responsible for the accuracy and timeliness of the data provided when creating an account or placing an order.
3.3. The user is responsible for maintaining the confidentiality of their login credentials and for all activities conducted under their account.

4. Placing Orders and Contracting Services

4.1. Selecting a service plan from those presented on the platform and completing the order process (including providing the requested data, uploading medical documents, and making the payment) constitutes a firm offer from the user to contract the respective services.
4.2. The contract is considered concluded when the provider confirms acceptance of the order, usually via a confirmation email.
4.3. The provider reserves the right to refuse an order in certain situations, such as, but not limited to: incomplete or clearly incorrect information provided, illegible or insufficient medical documents for a relevant analysis, suspicions of fraud, cases that clearly exceed the specific competence of the service offered, or technical impossibility of processing. In such a case, the user will be informed, and any amount paid will be fully refunded.

5. Prices and Payment Methods

5.1. The prices of the services are those displayed on the platform at the time of placing the order and are expressed in RON, including VAT.
5.2. Payment is made online, through a secure payment processor, using a valid bank card. OncoexpertAI does not store the user’s bank card details.
5.3. The service will be provided only after full payment confirmation.

6. Provision of Medical Documents by the User

6.1. The user is solely responsible for collecting, scanning/digitizing, and transmitting the medical documents necessary for the analysis. It is essential that the documents are complete, correct, legible, and relevant to the case presented.
6.2. The quality and accuracy of the analysis directly depend on the quality and completeness of the information provided by the user. Handwritten, illegible, or incomplete documents can negatively affect the analysis result or make it impossible to perform.
6.3. By uploading the documents, the user declares under their own responsibility that they have the legal right to dispose of that medical information (whether it is their own or they are acting as a legal representative) and that it is authentic.
6.4. The user undertakes to provide medical information in accordance with the number of pages specified for each pricing plan. Exceeding this number may require additional costs or may affect the response time, with prior notification to the user.

7. Informed Consent and Processing of Medical Data

7.1. Prior to the provision of services, the user must express their informed consent for the processing of their personal data, including sensitive medical data, and for the use of AI technology in the analysis process, by completing and accepting the dedicated form on the platform.
7.2. Lack of informed consent makes it impossible to provide the services.
7.3. Complete details regarding the collection, use, storage, and protection of personal data are available in the platform’s privacy policy.

8. Report Delivery and Deadlines

8.1. The analysis report will be delivered to the user in electronic format (usually PDF) to the email address provided, within the estimated timeframe specified for each service plan. Deadlines are calculated in business days and start from the moment of payment confirmation and receipt of all necessary documents and informed consent.
8.2. For the emergency service, the response time is 2-24 hours, depending on the time of information submission and case complexity, provided that the requirements from point 8.1 are met.
8.3. Any delays due to causes not attributable to the provider (e.g., major technical problems, exceptional volume of requests, need for additional clarifications from the user) will be communicated to the user.

9. Phone Call (Optional)

9.1. For service plans that include an optional phone call, it will be scheduled by mutual agreement between Dr. Onisim Florin and the user, within a reasonable time after the report delivery.
9.2. The duration of the call is as specified in the plan description. The purpose of the call is to clarify information from the written report and to answer questions related to it. The phone call does not constitute a new consultation and will not involve the analysis of new medical documents that were not part of the initial report.

10. Intellectual Property Rights

10.1. All content on the platform, including the design, texts, graphics, logos, images, as well as the structure and methodology of the generated reports (but not the user’s personal medical data contained therein) are the property of the provider or its licensors and are protected by copyright laws and other intellectual property rights.
10.2. The user is granted a limited, non-exclusive, and non-transferable right to access and use the content for personal and informational purposes, in connection with the purchased services. Any other use, including reproduction, modification, distribution, republication, or transmission of the content, is strictly prohibited without the prior written consent of the provider.
10.3. The analysis reports are intended exclusively for the personal use of the user and may not be published, duplicated, or commercialized without the explicit consent of the provider.

11. Limitation of Provider’s Liability

11.1. Absence of a traditional doctor-patient relationship: the use of the OncoexpertAI platform and services does not establish a doctor-patient relationship in the traditional and continuous sense. The services are specific, based on the information provided at a given time. Dr. Onisim Florin does not become the user’s attending physician merely by providing these services.

11.2. Responsibility for medical decisions: the user understands and accepts that the final decisions regarding diagnosis, treatment, and any other aspect of their medical care belong exclusively to the user and their attending physician(s). The information and reports provided by OncoexpertAI are intended to support this decision-making process, not to substitute it. The provider assumes no responsibility for medical decisions made by the user or third parties based on the information received.

11.3. No guarantees of results: the provider offers no guarantee, explicit or implicit, regarding the achievement of a specific therapeutic result, cure, or improvement in health status as a result of using the services. The progression of oncological conditions is complex and depends on multiple individual factors.

11.4. Accuracy of user-provided information: the provider is not responsible for errors, omissions, or inaccuracies in the analysis report resulting from incorrect, incomplete, or illegible information provided by the user.

11.5. Links to third parties: the platform may contain links to third-party websites that are not owned or controlled by the provider. The provider assumes no responsibility for the content, privacy policies, or practices of third-party sites.

11.6. Force majeure: the provider will not be liable for any delay or non-performance of its obligations if it is caused by force majeure events, as defined by Romanian law.

11.7. General limitation: to the maximum extent permitted by law, the provider’s total cumulative liability to the user for any claims arising from or in connection with these terms or the use of the services (whether contractual, tortious, or otherwise) shall not exceed the total amount paid by the user for the service that generated the respective claim.

12. Acceptable Use of the Platform

12.1. The user undertakes to use the platform and services legally, ethically, and in accordance with these terms.
12.2. The following are prohibited:
* Using the platform for illegal or fraudulent purposes.
* Uploading malicious content (viruses, malware, etc.).
* Attempting to gain unauthorized access to the platform’s systems.
* Any action that could damage, disable, or overload the platform.
* Collecting personal data of other users without their consent.
* Providing false, misleading, or third-party rights-infringing information.

13. Confidentiality

13.1. The provider undertakes to protect the confidentiality of users’ personal data, especially medical data.
13.2. The collection, processing, storage, and protection of personal data are governed by the platform’s privacy policy, which complies with the General Data Protection Regulation (GDPR – EU Regulation 2016/679) and applicable national legislation.
13.3. The user is encouraged to choose the data anonymization option for service plans that allow it, if they desire an additional level of confidentiality. Even in the case of anonymization, the provider will treat the information with utmost discretion.

14. Modification of Terms and Conditions

14.1. The provider reserves the right to modify or update these terms at any time, at its discretion. Any modification will take effect immediately upon publication on the platform.
14.2. Continued use of the platform after the publication of modifications constitutes the user’s acceptance of the new terms. It is the user’s responsibility to periodically check this page for updates.

15. Refund Policy

15.1. The conditions and procedure for refunds are detailed in the platform’s refund policy.

16. Notifications

16.1. Any communication or notification from the provider to the user will generally be made via email to the address provided by the user or by posting on the platform.
16.2. Any communication from the user to the provider shall be made via email to [Enter contact/support email address] or by other means indicated on the contact page.

17. Applicable Law and Jurisdiction

17.1. These terms and any dispute arising from or in connection with them shall be governed and interpreted in accordance with the laws of Romania.
17.2. Any dispute that cannot be resolved amicably will be submitted for resolution to the competent courts of Romania, at the provider’s headquarters or, as applicable, according to the legal provisions regarding material and territorial jurisdiction.

18. Final Provisions

18.1. Severability: the nullity or unenforceability of any provision of these terms will not affect the validity or enforceability of the other provisions, which will remain in force.
18.2. Waiver: no waiver by the provider of the exercise of any right or the invocation of a breach of these terms shall be deemed a waiver of the subsequent exercise of that right or the invocation of future breaches.
18.3. Headings: the section headings in these terms are used for convenience only and will not affect their interpretation.
18.4. Entire Agreement: these terms, together with the privacy policy, refund policy, and informed consent form, constitute the entire agreement between the user and the provider regarding the use of the platform and services, superseding any prior agreements or understandings, written or oral.
